1. Service Description

IsThisAScam is a multi-layer scam detection platform that analyzes URLs, emails, text messages, phone numbers, and other digital content to assess potential fraud, phishing, malware, and scam risk. The Service uses a combination of AI-powered analysis, domain intelligence, URL reputation checking, pattern matching, and threat intelligence databases to generate risk assessments.

The Service provides informational risk assessments only. It does not constitute legal, financial, or professional security advice. While we strive for accuracy, no automated scam detection system is perfect. The Service may produce false positives (flagging legitimate content as suspicious) or false negatives (failing to detect actual scams). You are solely responsible for your decisions based on the information provided.

The Service is available through our website, API, and browser extension. Features and availability may vary by subscription plan.

2. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service to facilitate, promote, or engage in any scam, fraud, phishing, or other illegal activity.
• Reverse-engineer, decompile, or attempt to extract the source code, algorithms, or models underlying the Service.
• Use the Service to build a competing product or service, or systematically scrape or harvest results for commercial purposes without written authorization.
• Circumvent, disable, or interfere with any security, rate-limiting, or access-control features of the Service.
• Submit content that is unlawful, defamatory, or violates the rights of others for the purpose of testing or abusing the system.
• Use automated means (bots, scrapers, crawlers) to access the Service beyond what is permitted through our official API and your subscription plan.
• Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity.
• Resell, sublicense, or redistribute access to the Service without our prior written consent.

We reserve the right to suspend or terminate your access to the Service at any time if we reasonably believe you have violated these acceptable use provisions.

3. Account Terms

Some features of the Service require you to create an account. When you create an account, you agree to:

• Provide accurate, current, and complete registration information.
• Maintain the security of your account credentials and immediately notify us of any unauthorized access.
• Accept responsibility for all activity that occurs under your account.
• Not share your account credentials with others or allow multiple individuals to use a single account (unless your plan explicitly permits team access).

You must be at least 13 years old (or 16 in the EEA) to create an account. By creating an account, you represent that you meet this age requirement. We reserve the right to suspend or close accounts that violate these terms.

4. Subscription Terms

4.1 Plans and Billing

The Service offers free and paid subscription plans. Paid plans are billed on a monthly or annual basis through our payment processor, Stripe. By subscribing to a paid plan, you authorize us to charge your designated payment method at the beginning of each billing cycle. All fees are stated in U.S. Dollars unless otherwise indicated.

4.2 Free Trial

We may offer a free trial period for certain paid plans. At the end of the trial, your subscription will automatically convert to a paid plan unless you cancel before the trial ends. We will notify you before any charges are incurred.

4.3 Refund Policy

We offer a 7-day refund policy from the date of your initial subscription purchase or renewal. If you are unsatisfied with the Service, you may request a full refund within 7 days of the charge by contacting us at support@isthisascam.to. Refunds requested after the 7-day window will be evaluated on a case-by-case basis but are not guaranteed. Refunds are issued to the original payment method and may take 5 to 10 business days to process.

4.4 Cancellation

You may cancel your subscription at any time from your account settings. Upon cancellation, you will retain access to paid features until the end of your current billing period. No prorated refunds are issued for partial billing periods (except within the 7-day refund window described above).

4.5 Price Changes

We may change subscription pricing from time to time. We will provide at least 30 days' advance notice of any price increase. The new price will take effect at the start of your next billing cycle following the notice period. If you do not agree to the new pricing, you may cancel your subscription before the new price takes effect.

5. API Terms

Access to the IsThisAScam API is subject to the following additional terms:

• API keys are personal and non-transferable. You are responsible for keeping your API keys secure. If you believe a key has been compromised, you must regenerate it immediately from your account dashboard.
• Rate limitsapply based on your subscription plan. Exceeding your plan's rate limits may result in temporary throttling or suspension of API access. Persistent abuse may result in account termination.
• Attribution: If you display IsThisAScam results in your own application, you must include appropriate attribution indicating that the analysis was provided by IsThisAScam, unless your plan includes white-label rights.
• No guarantees of uptime:While we strive to maintain high availability, the API is provided on an "as is" basis. We do not guarantee any specific uptime SLA unless explicitly stated in a separate enterprise agreement.
• Data caching: You may cache API responses for up to 24 hours. Long-term storage or redistribution of cached data is prohibited unless expressly permitted under your plan.

We reserve the right to modify, deprecate, or discontinue API endpoints with reasonable notice. We will provide at least 30 days' notice before removing any API endpoint that is actively in use.

6. Intellectual Property

The Service, including its design, features, content, algorithms, models, and underlying technology, is owned by Zeplik, Inc. and is protected by copyright, trademark, trade secret, and other intellectual property laws. These Terms do not grant you any right, title, or interest in the Service beyond the limited license to use it in accordance with these Terms.

You retain ownership of any content you submit to the Service for analysis. By submitting content, you grant us a limited, non-exclusive, worldwide license to process, analyze, and store that content solely for the purpose of providing and improving the Service. This license terminates when your content is deleted in accordance with our data retention practices.

You agree to indemnify, defend, and hold harmless Zeplik, Inc. and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property, privacy, or publicity right; or (d) any content you submit to the Service.

10. Modifications to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page and provide reasonable notice, which may include an email to the address associated with your account or a prominent notice within the Service.

Your continued use of the Service after the revised Terms take effect constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Service and, if applicable, cancel your subscription.

11. Termination

You may terminate your account at any time by deleting it from your account settings or by contacting us at support@isthisascam.to.

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to: violation of these Terms, extended periods of inactivity, requests by law enforcement, or discontinuation of the Service.

Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination will survive, including but not limited to: Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law.

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation within 30 days, either party may submit the dispute to binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall be conducted in the State of Delaware.

Class action waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than arbitration, you waive any right to a jury trial.

Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights.
